1.1. These General Conditions of Sale (hereinafter, General Conditions) have as their object the regulation of the purchase of Products, carried out remotely, via telephone or internet at the address http://www.claride.net/shop

2 Acceptance of the general conditions of sale
2.1. All purchases of Products made through the Site (hereinafter, the Purchase Contracts) by users who access it (hereinafter, the Customers) are governed by these General Conditions as well as by the Italian Consumer Code (Legislative Decree no. 206/2005), section II Distance contracts (articles 50 – 67) and by the Italian regulations on electronic commerce (Legislative Decree 70/2003).
2.2. With the conclusion of the Purchase Contracts, according to the procedure, the Customer accepts and undertakes to observe these General Conditions.
2.3. The Customer, therefore, is required to carefully read, before carrying out any purchase transaction, these General Conditions which Claride srl makes available to him also in order to allow reproduction and storage in compliance with the provisions of the art. 12, 3rd paragraph of the Legislative Decree. 70/2003.
2.4. Claride srl may modify, at any time and without notice, the content of the General Conditions. The General Conditions published on the Site at the time the purchase order is sent by the Customer will apply to each individual Purchase Contract.
3 Products
3.1. Claride is an online site for the sale of cosmetics, beauty products for body care and make up. (hereinafter, “products”).
3.2. All the Products offered are illustrated in detail on the Site, within the respective sections, distinguished by Product categories.
3.3. The visual representation of the Products on the Site, where available, has an indicative value and normally corresponds to the photographic image of the Products themselves and has the sole purpose of presenting them for sale, without any guarantee or commitment, on the part of Claride srl, regarding the exact correspondence of the image depicted on the Site with the actual Product; and this, with particular regard to its actual dimensions and/or the chromatic aspects of the Products and/or packaging.
3.4. In the event of a difference between the image and the written product sheet, the description on the product sheet always prevails.
4 Purchase procedure
4.1. The Customer can purchase the Products present in the electronic catalogue, illustrated in detail on the Site within the respective sections by product category, as described in the relevant information sheets contained on the Site, respecting the technical access procedures illustrated therein.
4.2. To purchase the Products, the Customer must register on the Site by entering their personal details, following the instructions provided by the registration program, they must choose the products via the “shopping cart” button, thus creating the order form in electronic format, following the instructions given therein. Purchase orders must be filled out exactly in their entirety (entering the shipping method and payment method). In the event that the Customer does not want to register on the Site, he will not be able to complete the purchase procedure in any case.
4.3. The Customer must insert the selected Products into the appropriate “Cart” and, after having chosen the courier and viewed and accepted the contribution for delivery costs, he can proceed with the purchase.
4.4. If the customer needs to modify the purchase order or to modify some data contained therein, he must follow the specific modification procedure contained on the Site. 5 Conclusion of the contract

5.2. Each Purchase Contract stipulated between Claride srl and the Customer must be considered concluded with the sending by Claride srl of the acceptance of the order to the Customer’s email address. This confirmation message will indicate an “Order Number”, to be used in any subsequent communication with Claride srl. The message will include, in addition to the information required by law, all the data entered by the Customer who undertakes to verify its correctness and promptly communicate any possible corrections. Possible additional costs caused by errors in the data not reported promptly will be the sole responsibility of the Customer.
5.3. Each order can be viewed by the customer on the site, in his own personal area, if he is registered, or by contacting Claride Customer Service, immediately after sending the order itself
5.4. It is possible that there may be occasional unavailability of the Products offered, in which case, if the Products chosen by the Customer are not, in whole or in part, available, the order will be sent with the available products after having sent communication to the Customer regarding the products not available.
5.5. Claride srl has the right to accept or not, at its discretion, the order sent by the Customer, without the latter being able to make claims or rights of any kind, for any reason, including compensation, in the event of non-acceptance of the order itself .
5.6. In particular, Claride srl reserves the right not to accept purchase proposals and cancel orders that do not give sufficient guarantees of solvency or if – also following a comparison with the circuit that manages credit card payments – anomalies are found in the transactions and in the payment methods used by the Customer.
5.7. The Customer will be able to check the contents of the purchase contracts concluded at any time by accessing their personal area of the Site, if they are registered, or by contacting the Claride srl Customer Service or may make claims or rights of any kind, for any reason, including compensation, in case of non-acceptance of the order itself. Such data will be available for a period of 12 months from delivery of the Products.
6 Product prices
All prices of the Products are clearly indicated on the Site and are inclusive of VAT. Delivery costs are adequately highlighted at the time of ordering The cost of each shipment may vary according to the delivery and payment method as well as the destination and total amount of the order.
7 Billing and Payment Methods
7.1. Claride srl issues an invoice for the Products purchased, sending it via e-mail to the Customer. For the issuing of the invoice, the information provided by the Customer is valid. No changes to the data will be possible after the invoice has been issued.
7.2. As detailed below in the relevant points, credit card payments only require authorization or a reservation of the money without actual charge when the customer places the order. Payment is therefore actually charged to the Customer only when the Products are delivered to the courier responsible for shipping. At this stage Claride srl will also issue the invoice relating to the order.

All data is transferred in an encoded form using an SSL certificate and is therefore not interceptable by external parties. Furthermore, the data is entered directly on the bank’s website, thus guaranteeing maximum security.
The order amount is not charged to the card immediately, but at a later stage, within the limits authorized by the Customer. When placing the order on the Claride srl website, only a payment authorization is requested for the amount indicated (very often at this moment an SMS / E-mail is sent to the Customer by the bank that issued the card) . The authorization does not imply the charging of the money but simply a reservation of the relevant amount. When the order is placed with the courier, forwarder or in any case another person appointed by Claride srl for the delivery, the amount due is actually requested to be debited . This guarantees that the sum is charged to the credit card only at the time of physical and certain shipment of the Products and only for the amount relating to the Products actually shipped.
8 Delivery methods and costs
8.1. Claride srl undertakes to deliver the goods without undue delay, normally within 36/48 hours, however no later than thirty days from the conclusion of the contract. Delivery of the Products will be carried out by courier, and times will vary depending on the destination. The times indicated at the time of the purchase order are however indicative.
8.2. Claride srl delivers to all the countries indicated on the Site and delivery will take place without an appointment unless explicitly requested, charging the customer an additional cost.
8.3. No responsibility, for any reason, can be charged by the Customer to Claride srl in the event of a delay in processing the order or in delivering the Products covered by the Purchase Contract.
8.4. The Products ordered will be sent to the postal address specified by the Customer. Upon delivery of the Products by Claride srl to the appointed courier, a shipping confirmation email will be sent to the Customer.
8.5. Deliveries will be made from Monday to Friday, during normal office hours, excluding national holidays according to the methods indicated by the courier chosen by the Customer. In case of impossibility to carry out the new delivery due to the absence of the recipient, Customer Service will attempt to contact the Customer to schedule a further delivery which however will involve an additional cost for the customer. In the event that Customer Service is unable to contact the Customer for the following 10 days or in the event of further impossibility of delivery due to the absence of the recipient, the Products covered by the order will be returned to Claride srl after 30 (thirty) days from date on which the Products included in the order were returned to Claride srl due to impossibility of carrying out the delivery, the contract will be considered terminated and the purchase order canceled pursuant to art. 1456 c.c.. Claride srl will refund the amount paid by the Customer, net of the costs of returning the Products and the costs of storing them at the branch of the courier responsible for delivery.
8.6. The termination of the contract and the refund amount will be communicated via email. L’importo del rimborso verrà accreditato sul mezzo di pagamento utilizzato dal Cliente per l’acquisto. In the event that, before the expiry of thirty days, the Customer requests to receive the purchased Products again, Claride srl will proceed with the new delivery after charging, in addition to the costs of the same, the costs of returning the Products to Claride srl and the costs of custody.
8.7. Upon delivery of the Products by the courier appointed by Claride srl, the Customer is required to scrupulously check:
a) That the anti-theft label is intact and the packaging is not damaged or otherwise altered.
b) That the number of pieces delivered corresponds to what is indicated in the transport document.
8.8. Any damage to the anti-theft label, packaging and Products or the mismatch in the number of pieces/packages or indications must be immediately reported by the Customer, who can contact Claride srl through Customer Service specifying the order for which such mix-ups occurred.
8.9. Cases of force majeure, unavailability of means of transport, as well as unforeseeable or unavoidable events that cause a delay in deliveries or make deliveries difficult or impossible or cause a significant increase in the delivery cost borne by Claride srl, will give it the right to split , postpone or cancel, in whole or in part, the expected delivery or to terminate the Purchase Contract. In such cases, it will be the responsibility of Claride srl to provide timely and adequate communication of its decisions to the e-mail address indicated by the Customer and the latter will have the right to a refund of any price already paid, excluding any further claim, for any reason, against by Claride srl.
9 Discount Coupons – Promotions
9.1. Any discount coupons or promotional codes may be entered when the Customer completes the purchase order. The system will update the total amount of the order net of the value of the voucher.
9.2. Il buono sconto potrà essere cumulabile con altre iniziative commerciali esclusivamente nelle ipotesi in cui sarà espressamente indicato.
10 Diritto di recesso e suoi effetti
10.1 Il Cliente ha il diritto di recedere dal contratto, senza indicarne le ragioni, entro 14 giorni. (periodo di recesso). Il diritto di recesso è regolato ai sensi di legge se il cliente-consumatore (ossia una persona fisica che acquista la merce per scopi non riferibili alla propria attività professionale, ovvero non effettua l’acquisto indicando nel modulo d’ordine un riferimento di Partita Iva) ha diritto di recedere dal contratto di acquisto per qualsiasi motivo. Nota Bene:Non possono esercitare il diritto di recesso i clienti che acquistano con Partita IVA.
10.2 Il periodo di recesso scade (i) dopo 14 giorni dal giorno in cui il Cliente o un terzo, diverso dal vettore e da questi designato, acquisisce il possesso fisico dei beni, ovvero (ii) nel caso di un contrattorelativo a beni multipli ordinati in un solo ordine e consegnati separatamente, dal giorno in cui il Cliente o un terzo, diverso dal vettore e da questi designato, acquisisce il possesso fisico dell’ultimo bene.
10.3. Per esercitare il diritto di recesso, il Cliente è tenuto a informare Claride srl (Claride srl – Via Musso 1 41053 Maranello (Mo)) della sua decisione di recedere dal contratto tramite una dichiarazione esplicita (compilando il modulo di recesso presente nel sito).
10.4. Per rispettare il termine di recesso, è sufficiente che il Cliente invii la comunicazione relativa all’esercizio del diritto di recesso prima della scadenza del periodo di recesso.
10.5. Se il Cliente recede dal presente contratto, saranno rimborsati tutti i pagamenti che ha effettuato a favore di Claride srl, esclusi i costi di consegna e i costi supplementari derivanti dalla eventuale scelta di un tipo di consegna diverso dal tipo meno costoso di consegna standard offerto, senza indebito ritardo e in ogni caso non oltre 14 giorni dal giorno in cui Claride srl sarà informata della decisione di recedere dal presente contratto. Detti rimborsi saranno effettuati utilizzando lo stesso mezzo di pagamento usato dal Cliente per la transazione iniziale, salvo che non venga espressamente convenuto altrimenti. Il rimborso può essere sospeso fino al ricevimento dei beni oppure fino all’avvenuta dimostrazione da parte del consumatore di aver rispedito i beni, seprecedente.
10.6. Il Cliente è tenuto a rispedire i beni o consegnarli a Claride srl, presso: Claride srlVia Musso 1 41053 Maranello (Modena) – talia, senza indebiti ritardi e in ogni caso entro 14 giorni dal giorno in cui ha comunicato il suo recesso dal presente contratto. Il termine è rispettato se il Cliente rispedisce i beni prima della scadenza del periodo di 14 giorni. I costi diretti della restituzione dei beni saranno a carico del Cliente. Il Cliente è responsabile solo della diminuzione del valore dei beni risultante da una manipolazione del bene diversa da quella necessaria per stabilire la natura, le caratteristiche e il funzionamento dei beni.
10.7. Il Cliente non potrà in ogni caso esercitare il diritto di recesso nel caso si tratti di beni sigillati che non si prestano ad essere restituiti per motivi igienici o connessi alla protezione della salute, sono stati aperti dopo la consegna, presentino segni di errata conservazione o inquinamento improprio (es: contaminazione da altri prodotti).
11 Non conformità dei prodotti e prodotti difettosi
11.1. I Prodotti offerti sul Sito sono conformi alla legislazione nazionale e comunitaria. Le immagini e i colori dei Prodotti pubblicati sul Sito potrebbero differire da quelli reali per effetto delle impostazioni locali dei sistemi e/o degli strumenti utilizzati per la loro visualizzazione.
11.2. 11.3. A communication will follow from the Claride srl staff indicating the reimbursement method which could take place, at the Customer’s discretion, also through discount vouchers on the next purchase exceeding the value of the goods to be refunded, excluding any further liability of Claride srl, to any title.
11.4. In any case, without prejudice to the provisions regarding the legal guarantee of conformity of goods, provided for by the Italian Consumer Code (Legislative Decree 206/2005, Part IV, Articles 102-135)
12 Communications and complaints
All communications or any complaints from the Customer towards Claride srl relating to the Purchase Contracts must be communicated by email to the address: info@claride.it.
13 Intellectual property rights
All trademarks (registered or otherwise), as well as any and all intellectual works, distinctive signs or names, images, photographs, written or graphic text and more generally any other intangible asset protected by laws and international conventions relating to intellectual property and industrial property reproduced on the Site remain the exclusive property of Claride srl and/or its licensors, without the Customer deriving any rights over the same from access to the Site and/or from the stipulation of the Purchase Contracts. Any use, even partial, of the same is prohibited without the prior written authorization of Claride srl, in whose favor all related rights are exclusively reserved.
14 Applicable law and competent court
14.1 These General Conditions and any and all contracts stipulated with the Customer are governed by Italian law, without prejudice to the application of community legislation and international treaties, when applicable, as well as national consumer protection legislation.
14.2 For any dispute relating to the interpretation, execution, validity or effectiveness of these General Conditions and of any contract stipulated with Customers, the Court of Modena will have exclusive jurisdiction.
